Dear Gary,ICC Document 470/834 on "Original" Documents
Further to our letter of 18 January 1999, we would like to refer you to Case 70 (enclosed) of ICC Publication No. 459 "Case Studies on Documentary Credits Problems, Queries, Answers", in which documents produced by "Aligned Export Documents System" are deemed as originals although they are in fact produced by reprographic means (invoices, packing lists, bills of lading, certificates etc. are produced by masking the "master" and copied with a black and white copier).
Therefore, whatever answers that the ICC Banking Commission is going to provide on what constitutes an original document in the future, they should not be inconsistent with Case No. 70. From the common sense point of view, Case No. 70 should be quite acceptable.
