I am a new premium member of your website ( just 3 days ). First 3 days i have read and tried to answer CDCS Exercise Questions, these questions and model answers are so helpful and i believe that it is worth to be a premium member just even for these questions and answers.

By the way i would like to ask a few questions about the model answers of CDCS exercises

Because of the English language is not my native, i might be misunderstood some of the explanations:

  1. Exercise 1 - Q5 - one of the discrepancies stated in question is " presentation after expiry " i assume that the credit is expired so that there is no need to give an advice of refusal in accordance with UCP . This rules are applicable if the credit is still valid. Otherwise explanations are so satisfactory, i am confused about the expiry.

"Your comments are right but ..."

  2. Exercise 1 - Q 16 - " three days safe harbour " and the wording " maximum "

I assume that the wording "reasonable time" is removed from the UCP because of the confusion of the allowed time for the examination of the docs. When i have read the Commentary on UCP 600, i could not recognize that the wording "maximum" has the same meaning. isn't it allowed to use the maximum 5 banking days for a simple set of documents?

    "Reasonable time is always ..."

  3. Q 41 and 42, i understood from the model answers for q41 and q42 that " Freight forwarder's bill of lading is not acceptable. " and " the Transport Documents issued by Freight Forwarders are not acceptable" has the different meanings

For Q 41, if the b/l is signed by a freight forwarder with the capacity of carrier or as agent for the carrier, the docs should be acceptable because of the unclear instruction (does not it override the both of the sub articles 14(l) and 20(a)(i) of UCP ? )

"For unclear instructions in an LC, ..."

For Q42, the instruction is override only the art. 14(l) of UCP ( so that the instruction is clear ) in this case b/l signed by Freight Forwarder as the capacity of carrier is not acceptable but if it is signed with the capacity of agent " as agent for the carrier " than it should be acceptable ?

"Please note the word used in UCP 600 article 14 (l) is ..."

    Is my understanding correct ?

Thanks and Regards

K.
